Been Charged Cashback But Didn't Receice Cash!!

HI,

What are the laws when you are charged cashback when you didn't ask and so didn't notice unitil you got home????

The restaurant is refusing to give me my money back, but will let me have a meal to teh value of the cashback!

    What is a restaurant doing offering cashback? (Yes, I know the OP wasn't offered it but was billed) I thought you had to have a special account to be able to give cashback in the first place.

    If it was a credit card payment then you can claim it under S75 of the Sale of Goods Act 1974 if a debit card then you would be best off contacting the bank.

    Whether you take them up on the offer on the meal is entirely up to you. Personally, if I was going to dine there anyway then I would do so but if not then I would insist on my money back. If you do decide on the meal then you could try blackmailing them into a bottle of wine as a gesture of goodwill too. Bear in mind that it is a lot cheaper for them to supply the meal than give your money back.

    When I go to a restaurant, I receive a bill. I then offer to pay, and if that is using a card, hopefully the waiter brings a portable device over to me (or I have to go up to the counter) whereupon I insert my car, the waiter asks to to check the amount and confirm payment by inserting my PIN.

    How can you be charged cashback and not notice?

    Anyway, just like any other scenario, after the event, it's a case of your word against theirs as to whether or not you received the cashback you were charged for. Some places ask you to sign the retailers receipt as confirmation you got the cashback in an attempt to avoid such disputes later.
