URGENT please help I am losing all my money

  • That's shocking, and the CSA should be doing something about it! I don't know what business unit your case is with, but the one I work at would take criminal compliance action against the employer even if they were in administration - I know because someone from criminal compliance asked us for referrals of exactly these types of cases.

    Personally, I would -
    - ring the CSA and ask them to change your case to direct pay, and tell them to cancel the DEO immediately in order that the employer cannot steal from you/the nrp any more
    - ask to speak to a manager about what can be done about forcing the employer to pay the deductions that they have already made before it's too late; if you have no joy from the manager, make a formal complaint in writing.

    Keep on nagging them. They should be doing more about this.
  • Miamoo, if you change your case to direct pay, or even if you ask for it to be closed, you will not lose your arrears. They will stay on your case until they have been paid off. You can go back to agency collection at any time in the future and the CSA will start collecting those arrears for you again.

    You could help your ex and yourselve by getting the csa to suspend the account and they cancel the DEO .You get your money his employer doesn't steal the arrested money .The only thing there though is if you were on benefits then some of the money is due to SOS if your ex has outstanding arrears

    Maybe try and get a written agreement drawn up etc between yourself if you and ex get along fine .Record the payment probaly via a standing order labeled child maintenance for x.

    In this case it looks like its not the CSA's fault :)

    no. you are seriously wrong there.

    you can close the case and keep the arrears payments. the chimps will tell you this is not possible, but if you put your request in writing then they legally have to comply with your request.

    this way, the DEO gets lifted, you can have a private arrangement for 15% (1 child) plus an agreement for the arrears.

    if he falters on it, set the csa back on him for enforcement of the arrears.

    as a footnote, if the co. is in administration, then you wont see a penny as they have nothing to lose by not forwarding the DEO and your ex will get the pleasure of paying twice, so it's in your best interests to get shot of the csa and his dishonest employer.

    The company does have something to lose really by not forwarding the DEO deductions; it's a criminal offence not to, and the payroll officer would be personally responsible and could be prosecuted, even after the company has folded.

    in theory, yes.

    in practice the only thing that will happen is the nrp will get the pleasure of paying twice.

    out of interest do you know if the csa have ever actually prosecuted an individual of a company for not forwarding a DEO??

    only, it's not exactly uncommon for this situation to rear it's ugly head.

  • The first thing you need to do is make sure that the CSA change to direct pay, so no further money can be kept by the company. Have you thought about going to the company with your ex and the paperwork in hand? Maybe a little pressure may help them to "see the light!"
