Bank Charges - Is my claim still valid?

Hello, can anyone help me?
I received a letter in early January from the Royal Bank of Scotland stating that as the OFT case had been unsuccessful and that they will consider the case closed in 8 weeks (4 weeks remaining) unless they hear from me otherwise.
Having read this months update can my case be re-opened due to financial hardship, here are the facts.
My claim is for just over £3600.
My claim was filed on 31st July 07.
My claim was placed on hold by the court on 15th August 07.
I am unemployed on income base JSA.
I am in arrears on my mortgage.
I am in an IVA.
Please, only informed answers required not opinion.

If you were in financial hardship, the claim should not have been held in the first instance. - there was an exemption for those in financial difficulty.
If you have only recently come into financial hardship, you should make your bank aware of this.
Edit: with regards to informed comments/opinion, you've probably come to the wrong place. At the bottom of every page it clearly states:This website is based on journalistic research. I agree with the above post.
You will get the best informed advice based on experience, but there are no guarantees I am afraid. Even a solicitor would not make a guarantee on this at present.
Why don't you spend some time skilling yourself up by reading up on the process.
Please ignore those people who post on this forum who deliberately try to misinform you. Don't be bullied by them, don't be blamed by them. You know who I mean.

The things I would suggest is whether you have spoken to your mortgage provider with regards to any help that they can give?
Did you have mortgage payment protection insurance and did you claim on it at the time?
Do you still bank with RBS and are still actively using the account?0
