Help with Nationwide

I applied to reclaim £2500 of bank charges back in july 2007 from the bank. This was obviously disputed and i began court proceeding with the small claims court where nationwide contested then the case was put on hold.

I have just recieved a letter from nationwide stating they will not be refunding me the charges and the clase will be closed if i do not respond in 8 weeks. The letter are the same as most of the letters people have said about on here.
At the bottom it states i can still apply to the financial ombudsmen if i am unhappy with the result. is this true?

What is my next move now? i am unsure what to do and do not want to give up.

    What are the terms of your stay with the county court?
    I have not worked for NatWest Bank since February 2009

    Nationwide, having reviewed the nature of your compliant, presumably feel it is unjustified following the outcome of the SC decision in November 2009, and for that reason have issued you the letter notifying you accordingly.
    They will close the case if you don't respond.

    But that doesn't affect your court claim.

    With regards to the FOS, imo you really should have complained to them before commencing any court action over the matter as (a) it's free and (b) it would demonstrate to the court that you had taken every possible option to resolve the matter before bringing it to court. Court action should be considered only as the last possible avenue.

    The FOS will not usually handle a complaint which has already been considered by a court or where court action is due to take place, and in any event you need to disclose any such action on the FOS claim form.

    Read the latest bank charges reclaim article, but for those like you with a court claim, you probably need to wait a couple more weeks for phase 2 of the article that will deal more specifically with court claims. (sign up to the weekly email if you haven't already done so, to ensure you receive notice of when this is available)
