Have I been subject to FRAUD

I saw an advertisement for an I phone in the LOOT Online. I spoke to the seller and we arranges a price of £280.
She sent me her bank details so I trusted her and sent the full amount.
She sent me a tracking number but after 3 weeks the item still never arrived. She said she going through the correct procedures to claim the lost item back on her insurance. She claimed the Royal Mail had lost the delivery.
Now she keeps saying she will transfer the full amount back, but never does.
She is now not answering her phone nor replying to her messages.
Some advice would be wonderful

Scammed- Clearly.
No reputable merchant is going to ask you to transfer funds to their bank account. You have no recourse from your bank for assistance with this if you dont recieve the item.
You could possibly contact the police though im not sure exactly what they would be able to do in this case.
NEVER EVER EVER EVER EVER EVER EVER EVER PAY via transferring money from your own bank account. Pay using a credit card/visa debit card ONLY. thay way you can ask for a chargeback if you do not recieve the goods you have been charged for. Granted it doesnt help in your case at the mo however for future reference.

Erm... you can't always get the charge back on a debit card, in fact with most you can't. S75 of the CCA 1974 only applies to credit cards as debit cards had not been invented at that time.[strike]-£20,000[/strike] 0!0 -
I spoke to Santander in December. The assistant on the phone seemed to think I was covered, especially over the xmas period when things like this happen all the time0

You are no more "covered" than if you went out into the street and gave the cash to a complete stranger. Which, in effect, is what you have done.
Sounds like you have enough details for the police to trace this person, but you'll have a hell of a job getting them out of the doughnut shop in order to do so.Je suis Charlie.0 -

Go into your local branch of her bank and ask them to confirm if their records match the address of this woman you've found in Southend. I doubt whether they'd tell you but you might be able to gauge by their reaction... Alternatively, pop round and see her! lol
