i.s and child maintainance

i read somewhere if you get income support and child maintainace you get full income support after april this year as well as yr child maintanance amount instead of them reducing your income support can somebody please tell me does the child maintainance thing have to be done through the csa for this to be done?

its just me and my husband are getting divorced and i dont know if i should go through csa or have a private agreement between us and just declare what he gives me to i.s he is telling me csa will take some of his money and it wont all go to the boys i dont know anything about how the csa work but if thats the case i would rather we did have a private agreement as that way any money they would take he could at least spend on the boys ?if that makes any sense
but i am afraid that if i do a private agreement instyead of using csa will this affect what the i.s will pay me after april ?im so confused obviously whatever he gives me i will declare but i dont see the point in going through the csa if they get a wedge of his money ?unless it will affect what the i.s will pay me if you understand my confusion

can anyone give me some advice please

When on IS you get to keep £20 per week of maintenance, IS is £64 per week so if he gives you more than £64 you wont qualify for IS.
You declare to IS what he is giving you, say £40 per week and they will deduct £20 from IS

It doesn't matter how you do, your IS will be affected until 12th April this year.

    Yes.

Income is income whether or not the arrangement is through the CSA.

disregard of child maintenance and the treatment of
    liable relative payments
    the child maintenance disregard

from the first day of the claimant’s first benefit week on or after 12.4.10
    1 the special

rules of attribution for lrps and child maintenance no longer apply to payments of
child maintenance. Any payment of child maintenance paid by or derived from an lr -
but not by the claimant or claimant’s partner - falls to be fully disregarded for the
purposes of is, jsa(ib) and esa(ir)

    2. Lrps which do not fall within the meaning of

child maintenance continue to be taken into account

    3. as a reminder, guidance to

dms will be issued in the form of another dmg memo nearer to 12.4.10.

The link explains it in full but basically, yes, it applies to IB ESA and JSA too.

    In short, yes.

I imagine many absent parents will suddenly start paying more for their offspring... ;)
