HMCS money claim online...are they being out of order?

Hi,
I have had 3 cases that were on hold since 2007, paid £30.00 each, I checked their website and could find nothing about bank charges, I decided to cancel the cases as dont know what, if anything would come of them due to the decision a while ago. I asked to be refunded as these have not gone to court, anyway, I sent an email, explaining it all, got a reply this morning telling me that no refund is going to be issued, rang them and the woman said that the office have decided to do this...I can understand if they wanted to take a bit for aministration charge, but not all of it, as it has not gone to court. but how can they justify keeping the whole amount?...any advice anyone

    When you file a claim with the small claims court (or mcol) you pay the appropriate filing fee. It is not refundable.

    If the case continues, you may have to pay further fees e.g. court hearing fee, etc.

    No, the court are not "being out of order"

    Once you file a claim you can only stop it by contacting MCOL by fax or email before 10am the next working day.

    You must quote your claim number, name and address, who your refund should be made payable to, and the reason why. Your claim will be withdrawn and a refund sent out by payable order.

    Where MCOL receive notification too late, the claim will be issued and the fee cannot be refunded
