    We all need a devils advocate ;) and I see what you're saying but I didn't claim for a number of reasons, I didn't realise I had the cover at the time - which sounds stupid I know but when I found I had I didn't think it would cover the heart condition - I don't know why but tbh I though it was just for redundancy. When I applied for the card in 1994 the system was very much "take the ppi or no go" I needed the card so did what I had to do.

    But, also, the good news is that you have discovered that your husband's heart condition is covered by this plan, and that you also have life cover - at this point maybe the thing to do is to make sure you have a copy of the terms & conditions & make a decision whether you would prefer to continue the insurance.

    Dunstonh, I think the poster said that they did not know they had cover to cover the heart condition and the poster stated in the first post that it was a case of "no insurance, no card" which suggests to me that it was compulsory to the card and "could" be a missale??
  • Well I've drafted letter 2 and added that their rep insisted that we needed the insurance to get the credit. Also, I know this may appear a little anal, but I'm still convinced someone else ticked the insurance box - to the point that I measured all the ticks on the application form :o and all my dh's ticks have a tail and are slightly curved measuring between 3 and 4mm quite consistently, where the ppi box tick is completely straight and measure 5mm - think I may mention that next time :o Thanks for all your thoughts and advice - I'll keep you informed how it goes.

    The problem is lack of credibility and being a complaint in an area where so many people are just trying it on. There is no proof to say it wasnt mis-sold or was mis-sold. So, balance of probability, as the FOS refer to it, would come in to play. The OP has no recognition at all of the original sale and has already put their opinion in writing to the firm. So any changes now are going to hurt, what is already a dented, credibility.

    As I said, I am viewing this more from the other side of the complaint with the devils advocate hat on. I'm not making any judgement on the validity of the complaint but highlighting potential issues.

  • Well after much thought we decided to send the second letter - not holding out much hope tbh - as dunstonh says by amending out original letter it simply looks like we are trying it on :( I can assure you we're not - in the early 90's it really was a case of take the cover or no card/credit - perhaps thats why I never looked at what it covered simply thought it was unemployment/redundancy and never occured to us that illness/heart condition might be covered. It's only as this has come in the media that we looked into it. We've cancelled it now (the insurance), we only owe £490 on the cc so doesn't seem worth prolonging the repayment by adding an insurance premium.
    Thanks for all the good and honest advice - I'll let you know the outcome.

    Sorry i dont want to be one of those people who leaves negative comments. The credit card was sold in 1994, he had a heart attack in 2000, its now 2010. you chose not to claim 10 years ago. im not sure how this relates to the ppi being mis-sold of which you dont even recall applying for the credit card.
