Car removed from Private Property Please Advise

So we have just come back from holiday to find my partners car which cost us a fortune a few years ago has been removed and it gets worse. We have two properties and I never stay at our old house and he only will when working away.

It's a BMW 745i with a value of about £12,000 now looking at price guides.

It has been removed for a £1500.00 parking debt. My partner stupidly did not pay some tickets and the address they went to was obviously the old one. :mad:

How on earth can they remove a car of this value for sucha small debt. Worse than this we have had a letter from dvla saying we have a fine from them for not reporting the change of owner????????

I know this is my husbands fault but to sell something with a value 8 times the fine is totally unfair surely?

Can someone advise me before he starts screaming down the phone to them which will probably get him no where.

Also I have been told they should provide a bill of sale and a return of funds over the costs which has not happened and seeing as this was 2 months ago I can't see any reason not to have this considering the owner has clearly been changed?

Please any advice will be greatly appreciated. Should I be getting legal advice?

    Your right, it will get him nowhere.
    Everything you have said is legal Im afraid. The car would have been the only assett they could get hold of so thats what they did.
    Presumably there is now a CCJ against him too.
    AFAIAA all he can do is get the proceeds and move on.

    Like you say - all his fault.

    So that's that he has lost a car that cost us a fortune because he was too lazy to pay some tickets.

    How would we go about getting the funds from the sale? Surely they should of been sent to the old address with the rest of the paperwork they sent?

    I would have thought they would send the proceeds out automatically.

    There may even be a cheque laying on the floor at the other house.
    I suppose you could ring them and enquire.

    Ah well, hope everythign turns out well for you both.
    I'm sure its a lesson learned.

  • I'm sure that if you explain all the circumstances to DVLA they will consider setting aside their penalty for not informing change of ownership.

    I think I would also contact the new owner and ask nicely what they paid for the vehicle.

    I think you should also get ready for a BIG shock when you actually receive the cheque, I have a feeling that the £1500 for the parking charges is going to dramatically increase:
    Bailiffs fees
    Recovering the vehicle
    Storage
    and Auctioneers (or other selling) charges.

    Insist that the Bailiffs give you a complete breakdown.

    £30 is a small debt. To have escalated to £1500 would have taken months and months of ignored correspondence. I fear someone is now being made to lie in the bed they have made.

    It was five tickets from one week parked in the same place from the looks of things. :j

    Seems like hes been a victim of his own success. If only we used finance like most people they would not of been able to take the car apparently.

    Yeah, it's really difficult to change the address on a V5 ;)

    I guess to be successful you have to have a certain attitude (arrogance perhaps?) which makes you think you can park where and how you like, then ignore enforceable council fines. BMW stereotypes anyone?!

    (and its probably a lot worse than anything that's been said on here lol)

    OP, not your fault, big ruler on the back of the legs, hopefully that'll larn him to pay his parking fines promptly from now on. Bet youre bottom dollar he's feeling sorry for himself now, me, I feel sorry for you (in the nicest possible way,)
