help with decision over refund of bank charges

i need your help.
i have been fighting with HSBC over my business account. I had previously applied under financial difficulties to get a refund of bank charges.
They had previously said no in all letter but in my last letter i said if that was their final decision i was heading to the ombudsmna.

Yesterday i received a letter from them offering me a measley £39 as a gesture of goodwill. I had previously wanted £170 of my charges refunded.
My partner said that by offering £39, they had admitted their wrong doings and i should fight for more by going to the ombudsman but i wanted your advice. What would you all do and do you think i would win if i went to the ombudsman

    Take a look at my signature which includes a link to the lending guide. Read with reference, firstly, to the definition of "micro enterprise" and see if you fit that definition. If you do then read chapter 9 and read it in full and see what you have done and how your circumstances fit. I would then write to them and quote it and individualise why you qualify with that criteria.
