Was there no 1-3 months warranty, like most independent traders?
Check your paperwork.
Yes, one month warranty, but that doesnt seem to go for anything with these people.I havent "Lost" my sense of humour, it was cruelly ripped away from me! :wall:0 -
As far as I am aware the SOGA doesnt entitle you necessary to have the car collected.
As for the rest. If you buy a 8 year old car you have to factor in running and repair costs. Sound like a mug who wanted a car they couldnt afford so compromised on age and didnt think about repairs etc.
As far as I can see the garage are saying they will fix it so you need to let them, just be more firm about it.0 -

Nice, just the sort of helpful, friendly comment thats making this a wonderful site
For your information, I was told the car had been inspected and all was good apart from the things the dealer has agreed to fix, it had also just been through an MOT, and it wasn't any cheaper than any others of similiar age / mileage / spec.
But apparently I'm a mug for thinking that an 8 year old BMW would have serious hidden defects????I havent "Lost" my sense of humour, it was cruelly ripped away from me! :wall:0 -

no need for that chap0 -
Unfortunate situation. The lesson learned is, if your lively hood depends on a working car don't pin your lively hood on the relibility of an 8 year old car that will have you in the garage more frequently than a newer one.
I'm in the same situation as you RE: self employment and have been since 1996.
I ditch cars at about 7 years old and 100,000 to 122,000 miles not because they are uneconomic to keep going but because I cannot afford to have cars in the garage and off the road as frequently as a car this age will accounting for the miles I do. It doesn't save me money vs. buying a much younger one. Like you if I don't turn up to work I don't get paid. Makes a newer car look "cheap" if it keeps you going.
It is very true to say, if you cannot afford the depreication on an under warranty 1 year old BMW 530d, your only slightly more able to afford the repairs, running costs and time off the road of an 8 year old 530d. The only difference is you don't need to fund a £30-£33K purchase price on the older one.
These old E39's consume suspension parts about once every 50,000-70,000 miles. People who know and love them factor this into the ownership costs and routine. Glow plugs are going to need to be replaced from time to time. Before the problem bites you do a search on "swirl flaps" of this engine. They are in the inlet manifold and can break off and get ingested into the engine which kills it. Replacement better design of inlet manifold is available and there is info. around on removing the swirl flaps and having blanking plates.
This is so the wrong car for your circumstances if money is that tight and your need to get to work this acute.0 -
If your livelyhood depends on your car, then the trick is not to buy higher spec but old car from dodgy dealer but to buy a new or new-ish car from a reputable dealer with WARRANTY!
I am sure in your budget you could have bought new or 1-yr old smaller car from a main dealer with manufacturer's warranty but you didn't.
BMW 5-series is a very complex car. Outside warranty, these cars are potential money pits.
One thing people often tend to forget. An expensive car may be very cheap after 7-8 years but its repair cost tends to reflect its original price and NOT the price it was bought for now!Happiness is buying an item and then not checking its price after a month to discover it was reduced further.0 -

Yes, thats the problem, I dont mind taking care of some of the issues (I am actually quite good at minor car repairs), but cant afford to get the immobiliser fixed, as I've been quoted around the £400 mark, which I dont have at the moment.
AdrianHi - "This is so the wrong car for your circumstances if money is that tight and your need to get to work this acute" - Money isnt normally this tight, its just that I am self employed, and this is me seeing the backlash from the quiet period over christmas.
Whats annoying me is that the car is under warranty, and the dealer isnt honouring it.
Would have buying a newer car made any difference??? Not if it had also developed a fault and the dealer refused to honour that warranty.
This seems to have developed in to an issue about my choice of car, whereas, if you read the origonal post, it was a question about what my LEGAL RIGHTS are in relation to this matter.
I challenge anyone who has posted comments about the choice of purchase to tell me 100% honestly that they have never bought anything that they have looked at in hindsight and regreted.
Once they have done that, then tell me how they would feel if, when asking for help regarding what rights they have, they had people basically telling them they were stupid for buying it, or they were a mug, etc.
Sorry to all who have posted constructive comments, but its bad enough being thousands of pounds out of pocket, without people basically lining up to kick me when I'm already down!I havent "Lost" my sense of humour, it was cruelly ripped away from me! :wall:0 -
Are you in the AA/RAC? If so will they take it back to the dealer for you?
I feel for you, I once had a 3.0 Manual S-Type Jag (One of the early ones) and it was nothing but trouble for three years, I then bought a 2002 one which was totally reliable, its just luck of the draw.I have a lot of problems with my neighbours, they hammer and bang on the walls sometimes until 2 or 3 in the morning - some nights I can hardly hear myself drilling
