CSA making a big mistake....Help please.

Thanks everyone for the advice. I rang the CSA today and they haven't recieved a letter from the MP, we were there when it was wrote out and we have a copy. They say they requested the case papers on the 14th January but haven't recieved them yet (there in Liverpool). They don't know when they will get them but will ring and let us know (i'm sure they will:mad:).
We rang solicitor and there sending another letter stating that this is urgent and needs to be put right. So we'll have to see what happens. I did ask more questions again today regarding the mother but they wouldn't tell me anything. They said i could get hubby's details from somewhere and pay a tenner for it.:rotfl:What do i want that for.
We were told last phone call with them that there was only 2 company's that could do the DNA test and they gave me the number, so i rang and that was the quote that was given. Hubby has no problem taking a DNA test, it's the cost and how we'll find the money. What would happen if this woman refused to be tested, would we loss all that money? I suppose we'll just have to gather up now for the test and see what happens when the case papers come through.

- If the agency can not assume parentage, then they can not calculate liability. In which case they will need to arrange a DNA test. Obviously if the DNA test returns negative, then it will cost the OP nothing.
- If liability has already been calculated, as there has been enough info for the agency to assume parentage, the OP in this case will need to apply to the court for both a DNA test and the whereabouts of the child.
Need the OP to confirm the position.
Hubby doesn't know this woman or child, he's never heard of them and all we know is the names and that they live in England somewhere. We didn't get a form the first time they contacted us and even when i rang there was no mention of a form. I have no doubt over your hubby, but whilst the csa can make mistakes , it cannot be ignored that you may only have part of the story
Perhaps you should get the profile of the case raised (if you are 120% sure of innocence) and highlight this via the media , someone will soon act quickly.0 -

I'm 1000% sure but i would never go to the media, could you imagine how my hubby would deal with everyone knowing he has schizophrenia. That would make things 1000 times worse for him and our family, he'd never cope, he'd go straight into relapse with the presure. We'll go to the highest that there is about the CSA through complaints, there is no way i'm letting this drop without a fight. I know my hubby isn't the first person this has happened to and the way the CSA are treating us (they don't seem to care)we won't be the last.Sometimes it seems that the going is just too rough.And things go wrong no matter what I do.Now and then it seems that life is just too much.But you've got the love I need to see me through.:j :j0 -

The story wouldn't be based around his health it would be based around the story that you are submitting here, that out of the blue the CSA are accusing someone of being the parent and taking action without following the rules assuming paternity or even checking that he is indeed the absent parent.
I assume this number on the letter is from the CSA and not a phishing scam?0 -

That is how they work things sadly.
Also, they can make all the mistakes, forget to send things, mislay information etc etc but all they have to say is "Sorry ... BUT what we are saying now still stands".
The person on the receiving end doesn't get that option.
I would be furious if I forked out almost £500 for a DNA test for the mother (the CSA are telling you is) to turn around and say either a) I've no idea what you're on about, the CSA have made a mistake or b) No, I don't want a DNA test done now.
I hope you can find a way to sort this out.

I agree with the advice given by others re your OH requesting his Data Protection File (there's a template letter in the download section at afairercsaforall, also the agency charge £10 to supply such - do not send cash).
The agency have clear guidelines when they can assume parentage, that's not to say that mistakes don't get made. Once in receipt of your OH file, you will be able to establish whats been happening with his case.A fairer CSA for all0
