would i get turned down for br and soa things

hi,
i've been seeking advice from cccs re br but are having to do an up to date budget before being referred to the br team. Myself and oh have been paying £459pm for 18mths on a dmp (approx 50k unsecured debts). The problem is that i am currently on maternity allowance which ends in mid march (income drop of £501pm) at which point i 'return' to work but my contract is a zero hrs contract with no guaranteed hrs and therefore no guaranteed wages - it also has a knockon effect with trying to arrange childcare at minimal notice so I'm trying to be realistic about the fact I may well not be earning anything until I can find more stable work.
Added to the fact is that a chunk of our dmp payments have come from my ex's maintenance payments which are now hugely in arrears.

The cccs's calculations are saying we have £594 disposable each month which would leave us paid off in 2018 and therefore unsuitable for br however the debt is approx 50k of which 45k+ is in my sole name. The £594 includes my maternity allowance which ends in march so I can't understand why I'm not suitable for br? I'm trying to be realistic about the situation we're going to be in shortly and to get this sorted before we get into a deeper mess. We've now been told that it may look more favourable if we make seperate appointments and do individual budgets reflecting what debt is in our names which makes sense but I just don't know where to start with how to seperate who pays what. All our finances go in and out of a joint account - how do we say who receives the tax credits or child benefit and who pays the bills/mortgage etc???

Also - the figures that the cccs allow for household food/clothes etc seem lower than the figures I'm seeing on soa's on other threads - we really struggle with 2adults/3 kids on £500 a month for groceries and it's breaking my heart that my sons are missing out on activities because we can't budget for them.

Help - I feel like I'm going round in circles and I really want to feel like I'm making progress with trying to get sorted. If the cccs say I'm unsuitable for br will this mean i'll get turned down by the court???? I can't keep going on in the situation we're in - we have damp walls practically falling down that we can't afford to repair - and i can't stand the stress of not knowing if we're going afford dmp repayments each month if maintenance doesn't come in or i don't get offered any hrs.

    hi cccs told me and oh to go on dmp but we told them we wanted to go br i went on the insolvency web site and filled the forms in on line and yes the allowances are a lot better for br.:)

    hi - thanks for that - I wasn't sure if i was being unreasonable but I just can't see us staying sane if we carry on the way we are.
  • CCCS were adamant last week that I should go on an IVA insisting that an OR wouldnt allow any more than £291 for groceries for 2 adults and 2 children which i refuse to believe.

    Spoke to national debtline after who were amazing and BR is def the way forward for me.

    Hi I am all very new to this, but I know when I spoke to Pay Plan they were very stanch about what they allow and they said I had about £400 left for debt repayment...... and if I had gone on a DMP there is actually no way I could've coped.

    I spoke to the national debt helpline who were so helpful, so if you haven't done so already it might be a good idea to do so.

    Also I found it really helpful to put up my SOA here and I got loads of of help and advice with it, so I can be prepared for the future.

    Most OR's would be unlikely to question housekeeping expenditure up to around £500 for two adults and two children. £291 is close to the maximum the OR would normally expect to see for a single parent and two children. However, there really are no hard and fast rules, and most OR's are prepared to allow higher amounts when there is good reason to do so. For instance, a single parent with two teenage boys is likely to be able to justify far more on groceries - possibly nearer the level for three adults :)

  • I am in a 2 adult & 3 children family, I was advised by CAB that it wasn't unreasonable to put £650 for groceries (including cleaning materials). I went BR just before Christmas so is an up to date idea of what you could be allowed.

    I think if you were to go for BR then you would put the entire living expenses of the family on your SOA and then enter your partners contribution towards the costs in the income section but I expect someone who knows a little more will be along to help. It might be a good idea to do your SOA and post it on here so that you can get a better idea of where you stand?
  • thanks for the replies people - I've got so depressed lately by the thought of trying to scrape around for speare pennies for another 8/9 yrs that i just haven't been able to see the wood for the trees iykwim. I'm going to call the national debtline as still not getting anywhere with cccs. The other problem with cccs is that they close at 6pm for existing clients - oh doesn't finish work until nearly 7pm and isn't owed holiday so has no way at present of being there when i call them and i need the moral support at the moment!!

    O please try not to get depressed, I know it is really hard. I had a really good conversation with my Sister and one of my friends last night and it helped no end to that the people that matter are not judgemental. It is hard trying to make calls whilst you are at work and I totally understand that.

    I did find the national debthelpline really good as was the CAB. Just remember that you are not alone.

  • go to insolvency.gov.uk search for tech manual go to section 31.7.18 and there is the answers on a spreadsheet courtesy O.R. holidays, pets, glasses etc etc
