JSA back payment

I have recently started claiming JSA and received my confirmation letter last week, I was claiming for it to be backdated two weeks and it was decline. I wrote to them asking for them to look at the back payment again, can anyone give me pointers if they are likely to pay me given the information below?

I was made redundant on 31st December. I went to apply for JSA online but couldn't because I required two numbers off my P45. I received this on 11th January and claimed online the same day. I had my first appointment a few days later. To me, this is an extremely valid reason not to claim, it wasn't actually possible for me to claim without these numbers from my P45.

Has anyone else been in a similar situation or know if they are likely to agree to the back payment?

    As far as I know it goes by the day you make the claim, so therefor it will go by the 11th January
  • On the JSA claim form there was a section for back payments to fill out if you had a reason for not being able to claim immediately. I just presumed that if they had this section then it was possible to back pay a claim for a valid reason.

    You are right it is possible to get a backdated payment for a valid reason.

    There is nothing on the P45 that prevents you from claiming - unless the two things you were missing were digits from your national insurance number - even then that is still your fault for not knowing it in the first place.

    To me, they have made the right decision initially and it should be upheld on both review and appeal.

    Unless I'm missing something, I don't see how the decision can be correct.

    What were the missing items you needed from your P45

    As far as i know what is printed on your P45 is virtually what is printed on your last payslip
    NI number
    Pay to date
    Tax to date
    NI to date
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    You have to satisy one of the prescribed circumstances to be entitled to backdated JSA, the reason you have given does not not satisfy any of these circumstances. The DWP should give you a list to the prescribed circumstances when they send you the disallowance letter.

    OP, is this the new 'full' online claim? My understanding is that this system tells you when you commence the claim that you must complete it within seven days.

    This complies with the law, you are effectively requesting a claim form and receiving one. The law dictates that, when giving you the claim form, the SoS must tell you the date by which it should be returned fully completed. If you don't then your claim is not made.

    Unfortunately, not having the required information (and Im assuming it's the tax district etc) is not sufficient grounds for backdating.

    You have more chances of winning the lottery that getting JSA backdated. This from a friend that works for the DWP.
