Hi everyone,
I purchased my flat back in 2003. The previous owner was involved in a dispute with the management company about the roof which needed immeditate support in the form of inverted 'A' frames, now, when we were purchasing the flat, the vendors estate agents got a quote for the work to be done which was £500 to which the vendor knocked off the asking price
I was just looking through the lease and came accross the following;
2. That the manager will keep the main structures properly repaired, supported, maintained reconstructed and cleansed and subject to the Lessee paying the service charge will keep the Lessee indemnified against all costs and expenses in connection therewith.
my question is this; can i somehow reclaim back the money we paid for the roof as it seems we're not responsible
? and how would i go about doing this
?
any help gratefuly received!!
Best Wishes
Luke

why did your solicitor not pick up on this at the time ? did you tell him that there was a roofing dispute at the time of purchase ?0

I'm not sure that the wording you quote means that you are NOT responsible.
Most service charges are variable and reflect the work required to be undertaken by the management company, in which case they could require you to make an increased service charge payment reflecting major works required.0
