faulty laptop

i got a laptop in may 2009 within 4 months there was sparks coming from the side, i contacted comet where i purchased it from they said to contact hewlett packard, i did and my laptop was sent for repair, then the first week of december it broke again, this time there was sparks and smoke coming from the side, it got sent to hp for repair, now it has broke again theres a crackling noise coming from the side and smoke :mad:
hewlett packard said it has to break down 4 times befor they replace it :mad: does anyone know my rights with this and what i should do.

    You dont really have any more rights than they are providing. Frustrating but you have to stick with it unless you manage to convince them to change it as you fear it to be a fire risk.

    You don't have any rights at all with regard to Hewlett Packard, your contract is with Comet and all your rights lie in that direction.

    If I were you, I would first take it back to the Comet branch where I purchased it, explain that it's not only faulty but also dangerous, and you want a replacement. If they refuse (which they probably will), tell them that you will take up the matter of a dangerous product with Trading Standards. Also, if they continue to refuse, you must put your request for a replacement in writing to Comet, sent by recorded delivery.

    You must bear in mind that your contract is with Comet, and only Comet, so even if you persist in trying to get it replaced or repaired by HP, you must have made a claim against Comet, because it is only Comet who can be held legally liable. If you don't claim against Comet a.s.a.p., then the longer you mess around with HP the weaker your case against Comet will be.

  • i took it to comet the 1st time this happened and they said its hp's responsibility, hp said it was comets.

    Hp are liable for the warranty repairs which is what your getting.

    Comet is responsible for claims under the sale of goods act and your statutory rights.

    Take it back to Comet. You followed their recommended returns procedure and it hasn't worked.

    Remember to take any HP paperwork with you to show you followed their procedures.
  • What's your model number of the laptop? HP had a lot of problems with their pavilion laptops where the nvida graphic card would overheat and essentially melt. I know as I have an expensive paperweight. Grrr. Some pavilion latops did get an extended warranty to cover the problems but obvioulsy my model did not fall into this category. I can't post the link but on the HP website it lists all the impacted laptops ...

    Even the extended warranty isn't good enough, in my ind, asI expect a £600 laptop to last longer than 3 years, or am I expecting too much.Contacted BBC Watchdog today to ask as much.
