Urgent - Please help!!

Dear People,

I need some help urgently…….Last year was a hell of a one for me, I went bankrupt in March 2009 after a string of unemployment and some very hasty and bad decisions.
Luckily the bad times are behind me and I have started the new year on a flyer, I have managed to sort out all my direct debits and I am very organised. Also I must add that I have been working for about 7 months now so this has helped me on back on track.
Although the above sounds all very encouraging there is one cog stuck in my wheel oiled wheel and that is I owe my Landlord £700.00 back rent, now this has been a problem since last August and if the Landlord wasn’t a good friend of my fathers things may have been different and we now might be homeless. Last week I received a letter from the Landlord explaining it must be paid in 7 days or they will take further action, I am very worried and I am starting to have the same stomach pains and sleepless nights I did when going through my debt crisis and 2009.

The problem that I need some advice with is the fact that I was looking to take a small loan of about £1000.00 to pay this off, I know what you are thinking and I have tried to think of another solution however all those doors are closed. Now that I am working and my job is secure I have no problems with paying the amount of monthly however no one will give me credit because of the bankruptcy……will they?

    Do you have a credit union where you live? Although you are supposed to save for 3 months before applying for a loan they have been known to waive this rule in exceptional circumstances such as rent arrears which could lead to eviction.

    You would have to contact them directly - a lot of people involved with CU are volunteers and will be able to give advice.
    If you cannot borrow the whole amount would your l/l accept a repayment plan?
    If you post an SOA on the Debtfree wannabe board they will help you on there.

  • If you want to stay in the property make the LL an offer of whatever lump sum you can pay, and the balance over 2/3 months, he obviously wants his money

    an official loan is unlikely, are you discharged yet?

    DON"T BORROW!!!!

    I'm an ex letting agent and do this:

    Don't bury your head, speak to your landlord and be honest with him. Try an make an arrangement with him, moving home costs money, money you could spend getting back on track with him.

    Check your tenancy agreement, in fact do you have one??

    Is the back rent related to your bankruptcy? If so is he named on the petition?

    If you're not discharged and it is in the petition, paying him extra could be construed as making him a preferential creditor, so be careful or you may have your BR extended.

    It seems the 'relationship' has suffered for him to send you a letter, so use your rights to protect your tenture, if you have a tenancy agreement then you have plenty of rights and time to sort this out, if you haven't then you have about the same, it's just he has a more difficult route to getting you out.

    It begs the question though, if you've been working for seven months and he's been owed for 5 months why haven't you made an arrangement sooner??

    Can you not come to some arrangement with him? Maybe pay an extra bit on top of your normal rent until it is cleared?

    Hope you get it sorted soon, but please don't go and borrow any money from anywhere, there must be a better solution somewhere for you.

  • the landlord must understand that to evict you he will incurr court costs if you don't meekly go and as you are bk how can he get his money back from you. I'm a landlord and I'm on HIS side in this , so I can see if I have a good tenant that had a blip but wants to pay I would accomodate. However arrears is a legal cause for eviction. all the shelters in the world can't help unles they got somewhere for you to go. If LL goes to court the judge DOES NOT HAVE AN OPTION but to grant eviction. Really sincere good luck with this.
