    The DPA states that a person must be identifiable by the data. A card number and transaction number held on a third party system isnt that.

    My opinion of course.

    I am just pointing out just because they paid by card doesnt mean its automatically covered by DPA. there are conditions.

    Card details are covered by the DPA as personal information.
    Its interesting topic though.
    Sorry im new, and cant post links, but if you go to the ICO website and download the guide, you will see for yourself.
    It was a friend who is a law graduate actually told me to do that - so I have high confidence that it is correct. After all, they caved in pretty fast and gave me the refund - rather than wasting resources having to track the payment on their systems no doubt...
