    I believe that, if a house is owned jointly, one person can insist that the property is sold, as could be the case with a childless couple who are separating.

    Yes, it's called partition action.

    Would he not get money from the sale?

    I believe some people (I think they are called landlords) rent houses to other people (I've heard them called tenants) for money. Its a novel idea but certainly worth considering.

    When it comes up for renewal the note is seen but the customer does not declare the capital as it has all been spent - can the Pension Service consider deprivation of capital? (Not really but...)

    Yes it can be looked at and considered deprivation or in most cases where customer cannot prove what they spent money on, can be classed as still having the actual capital. Doing several cases now!
