Hotel deposit retention

I booked a hotel for September and admittedly paid £150 which was deemed "non refundable"

However, I have now found I cannot take the booking so have given them 8 months notice on cancellation but they state they are still unable to refund

:(

Is this lawful?

I know that given the timing (a major event is in the area at the time) they will easily re let the room, so feel I am being treated unfairly

    Sorry, i know it sounds unfair but you booked it under non refundable conditions so you havent a leg to stand on. So of course its lawful. You could ask them for a partial refund given the length of time between now and Sept but i wouldnt hold your breath.

    Could you not sell it on.

    Well,

    my concern is that they have already sold it, so effectively they are making the booking fee from me plus the people that get the room!

    Just because it was agreed to and in the terms, does NOT make it lawful

    Of course it does! You agreed to the terms and conditions when booking, did you not?!

    1) That's just business for you - what about the times they cannot sell on cancellations?

    2) Your only legal get out is if you can show the relative condition to be unfair, otherwise obviously agreed terms are lawful!

    I think penalty law would come in - penalty can only be as great as their loss

    Why have you posted this here and on CAG?

    The advice that you have been given here is correct. The links given on CAG do not even relate to your scenario, so I would take them with a large pinch of salt.

    I would also suggest that you are a tad more polite when responding to people!

  • Coming at it from a common sense angle as I know absolutely nothing about law surely everyone takes a risk if choosing a non refundable room rate. It's absolutely no different to the £9 travelodge rooms. If you don't want to take that risk choose fully flexible.

    Hopefully you will be able to put the hotel room on ebay and fingers crossed make a profit

    I'm sorry, in what way have I not been polite?

    Further, what is the problem with posting on CAG and MSE as the 2 sites have a lot of different members, I'm getting maximum exposure to the query

    unfortunately as I have cancelled they have now resold the room - this is why I am so annoyed about it - they are effectively making an extra £150 on the room
