Hi all.
I have bought a couple of books via Amazon Marketplace .... just realised that I don't actually need them .... they haven't been delivered yet ...
Can they be rejected under the DSR?
Thanks
Mark

I would think it depends on who you actually bought it from. IF it was a business then most certainly yes, they do have to comply. If they are not acting in the course of business then i would have thought not as DSR is aimed at Business to consumer selling. Somebody may correct me on this as im thinking of how the DSR apply to ebay as this would be equivalent to anybody (not a business) listing an item as buy it now only.Back by no demand whatsoever.0

Amazon allow customer returns for any reason as long as you notify the seller that you are returning the books. You will need to pay your return postage though and the books need to arrive back with the seller before they are obliged to refund, so might be an idea to use recorded delivery.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Thanks for clearing up amazon's procedure but this bit is incorrect, DSR's strictly state the refund process should not be delayed until goods have been received back.Back by no demand whatsoever.0 -

The OP specifically asked about Amazon, so whilst a buyer can always go to law to enforce their rights under the DSRs it does pay to know what the policy is for individual sites: I'd also point out that after 7 days Amazon do not require the seller to refund the initial postage costs on return, just the item cost.
Anyway, Amazon:

[FONT=verdana,arial,helvetica][SIZE=-1]Where you are withdrawing from your purchase within the first 7 working days after delivery and there has been no error on the seller's part, the seller will refund the cost of the item and the cost of sending the item to you as follows: (1) where you are returning an item that was part of a larger order, the seller will refund the per-item charge for delivery that you incurred, (2) where you are returning an entire order, the seller will refund the applicable per-item delivery charges and the per-delivery charge that you incurred, (3) sellers are only required to refund standard postage charges for items delivered outside the UK, (4) where your seller collects an item from you, the seller will have the right to recover the costs of collection from you, and (5) if you use a personalised pre-paid return label, the seller is entitled to deduct the return postage from your overall refund. Please note that, with respect to returns initiated during the first 7 working days after delivery, sellers are not required to refund the cost of giftwrapping, returning the item to the seller, and other services provided to you in connection with your purchase unless you return the item to the seller because of an error on the sellers part or because it is defective. I beg to differ but whatever you say...isplumm wrote:Can they be rejected under the DSR?
Original post.:o
I see what your saying but DSR allow more rights than Amazons policy and this is what the OP asked about so what you posted was indeed incorrect for this particular situation as long as the OP is still within the 7 working day limit.Back by no demand whatsoever.0
