santander - proof if income/expenditure

Hi there,
Hope someone can help?

Recently I have sent letters to all of our creditors asking to accept a token payment (Sample letter on national debtline) as our circumstances have changed and are unable to meet full payments at present.
some have replied & have already accepted our token payment.

Although Santander want relavant proof, bank statement, details of income, utility bills & details of all other creditors ( I have already sent details of all other creditors anyway)

Do I have to send these details to them? considering other companies have accepted without this proof. What is my next step?

Thanks
Emma

  • If your token payment is all you can afford then they can not make you pay more, so regardless of what proof they have it is not going to help them.

Just be sure you have no bank accounts with Santander, as they can legally take any money they want out of your account. Think this will also applies to banks within the newly expanded Santander business (Abbey, Bradford & Bingley and Alliance and Leicester (A&L change in April I believe but are under the Santander umbrella already). B&B and Abbey are now called Santander.

You could write to them explaining that your other creditors have been helpful and you are surprised a big company like Santander are less helpful.
Regardless of if you write to them or not, just keep paying them the token payment, they will accept it rather than get nothing.

All you are required to provide is the income / expenditure sheet that national debtline provide. http://www.nationaldebtline.co.uk/england_wales/pdf/personal-budget-sheet/pbs-monthly.pdf

Only a judge has rights to ask to see your bank statements etc.

As above, if your money debts/savings are with the same banking group, you need to move it otherwise they can offset

  • Thank you for your replys. No I do not bank with Santander, it is two store cards which I owe the money to.
I will go with what you say and write back, is there any official/template letters anywhere stating that I do not have to send BS etc?

    Thanks

    Dear Sir/Madam

    Account No: 4563210025897412

Thank you for your letter of DD-MM-YYYY concerning the above account.

We are are sorry that you feel unable to accept the offer which we have made. The majority of our other
creditors have accepted the offers made to them and we have commenced payments. We cannot offer you
more because we can only afford £_____ per month between all our other creditors, and it would be wrong to
cease or reduce payments to our other creditors in favour of your company. The offer made to you is on a pro
rata basis, as used by the county court.

In the light of the other creditors agreeing to our repayment plan, please would you reconsider our offer. We
will be making the payments in line with the offer to your company, on a weekly/monthly basis, as a gesture of
    goodwill.

We have enclosed a copy of our budget sheet as you requested, and We look forward to hearing from you as soon as possible.

    Yours faithfully

    Mr A N Other

  • Not sure if there is templates, just right to them saying they have no legal right to request to see your bank statements. And any future request from them asking for a copy will taken as them trying to imply they are in postion of authority.
Out of interest who are your store cards with?
  • DarkConvict to the rescue yet again lol.
Regardless of what they reply to your letter with, continue to make token payments. If they do not reply than this can be taken as them accepting your token payment.
  • Brill, thank you both.
My store cards are Comet & Evans.
  • Who are they through?

I presume through Santander, The comet card I got when I purchased a pc from them a few years ago & the Evans one just by signing up in the shop. The first I've heard from Santander is when I stopped paying regular payments.

I would use the above template first, and let us know of any reply etc you get.
