how about this ccj

hi there, any advice on this? i really dont understand. i got a ccj through no fault of my own on the 15th of may, i paid it off in full on 16th june and got a letter from the registry of trust or whatever it is.
is this marked so it can disappear? the letter said it would be taken off if paid within 30 days, which just missed the deadline.
does this still look bad on my credit history even if its paid off? what will happen after 6 years?
im so mad at this whole thing even though it wasnt even my fault.

If it wasn't your fault and you could poove that, then you should have disputed it at that time rather than paying up.

Since it's in your name and you have paid it, you have effectively accepted liability. It will reamin on your credit file for 6 years (from the date it was isseued I think), after which time it will drop off your credit report and creditors won't be able to see it.

There's nothing you can do about it now, I'm afraid.

Even though you admitted and paid the alleged debt, if you believe the claim was brought incorrectly, for example, if you've been the victim of identity fraud, you can apply for the case to be "Set Aside"

If your application is granted, this takes the claim back to the beginning, you then apply to have the claim dismissed, should you be successful, ask the court if your out of pocket expenses can be awarded against the original claimant, this should include your fee of £75.00 for the set aside application.

If you decide to pursue a set aside application, be sure to include ALL documented evidence why this claim should not have been registered against you.

Use this form for your set aside application.

hi it wasnt my fault in that it was identity fraud, ill explain what happened.

in 2008 i was in a car crash, i skidded and hit the back of a car so had to get a new front bumper and bonnet fitted. the guy i went to has a reputation for fleecing women but i didnt find that out till later. So he quoted me £270 which was a lot lower than anyone else, i accepted his quote and went on holiday to Turkey while he was doing the work on my car.

When i came home a week later, i called him that day and asked about the car. he said it wasnt done yet. This went on for 3 or 4 days, in which time, it took me four buses to get to work, i had to pay extra childcare and my cat had to stay in the cattery where he had been since i was on holiday as the kennels, you needed a car to get there. This cost me about £100 in all for this inconvenience,

Eventually after 4 days of him fobbing me off, my friend ran me to the garage, he wasnt there so i spoke to the other mechanic who said that nothing had been done on my car yet. I said i wasnt leaving till it was fixed because i had to get my son, my cat and get to work.
the owner came back about an hour after id been waiting as his mechanic had phoned him and said i wouldnt leave.
Eventually after a lot of excuses from him (he said theyd had loads of trouble fixing the car as and i quote 'they had to import parts from japan' i know this is rubbish as the car is a standard old honda civic (i know a fair bit about cars)
so he fixed it and we agreed i would pay him four days later on my pay day. He was happy with this, and i wrote down my name and address as receipt.
in the office, he told me that because the job had been done in a rush, the headlight wasnt fixed properly and if i was stopped by the police, i was to say it wasnt him that fixed it, and also said he would reduce the price if i paid cash so he didnt have to put it through the books,

two days later i was driving home and the headlight all but fell off, i had to get another garage to fix it.
WHen i was in the pub, the day before paying him, the owner of the pub knew the owner of the garage and told me about his reputation for conning women, which would fit in with everything he had told me. The pub owner says i wouldnt pay him if i was you.
when the garage owner phoned looking for payment, i refused to pay him and told him why.
I heard nothing else from him until a year later i got a solicitors letter from him saying i owed him £495 or he would take me to court. This wasnt even the right figure. I replied i would give him £10 per week until the £270 was paid, this was refused and it went to court, i got advice from a terrible solicitor who advised i didnt need to go to court to dispute this, and inevitably i lost by default because i had been advised by my lawyer not to go.
THis then ended up with me having a CCJ which was paid in full a month later.
It was the worst time of my life if im honest.

Sorry to sound harsh but have you actually considered that maybe you need to look at yourself a little, i.e. stop being so bloody trusting!

You need to explain all this in form N244 (HMRC) and apply to get the CCJ set-aside asap! Luckily 10past6 is here to help.....

    Eh?

This is NOT identity fraud. You should have contested the court case at the time - or paid up. Please have a think about whom you trust. You are correct, the solicitor who advised you not to go to court is terrible. When someone takes you to court, you have 2 choices - either to contest it or to pay up beforehand.

Yes, this is not identity fraud, all you can do is dispute the amount.

As you have already realised you lost the case by not attending, if you are asked to attend the court you must go otherwise you are admitting the case in favour of the other party.

But based on what you have said, did, and how long this has gone on for, i highly doubt you will get anywhere now.
