won my esa tribuneral what happens now

today l attended my tribuneral for my esa to b continued and am relieved to say l won
so my Q is :
what happens nxt ?
have still been getting esa since my medical last june £64.20 pw
the tribuneral said they will inform esa of their descision and said something about back pay to june?
does this mean the rate is more now
never been down this road so if anyone can give me any pointers ld b v happy:)

According to what group they put you in (support group or Work Related ACtivity Group), you will get these premiums backdated as you would have had the £64.30 carrying on whilst the appeal was being heard!

The work related group is @£89 per week and the support group is @£95 per week and you will recieve a lump sum of the money that you are owed (the rate you should have had less the £64 you have been paid) from week 14 of your ESA claim and it took about 3 week to get it in my husbands case.0 -

been attendiing royal british legion for support on a mandatory 6 visits {l think}

I would be very suprised if your in the support group as only about 5% of people are and they are the most seriously ill/disabled of claimants so I would work on the @£89 per week of the work related activity group and it took 3 weeks for my husband to recieve the money he was owed (he is in the support group).
I wouldnt phone on monday because the papers wont have moved on never mind being imput to the computor yet, we rang after a week and it still hadnt been proccessed but had in about 10 days.0 -

Slightly of the subject but can I ask you how found the tribunal?? I found out today that mine has been scheduled for 5/3/09. I'm dreading it as I thought the ATOS interview was bad enough. I suffer from depression and at the moment things have been really bad, I had just had a complete meltdown at my CPN appointment today and got home to find the letter. Did you produce evidence?? I already have a letter from my CPN and my psychiatrist is going to give me a letter to explain my condition. I have a local rep from benefits in action who took on my appeal (although might be closing to lack of funding) who will represent me but I'm getting really anxious about it. At the ATOS appointment I scored nil points because I felt he was answering the questions for me but his comments stated that I was well groomed and well presented (this is my mask as i have problems accepting my depression) but stated I might be fit for return to work in 6 months but still failed me. Since then my depression has got worse and trying to keep my head above water but in a complete state about this appeal. I've been attending the job center during this time for my pathways to work interviews and the man keeps telling me I'm know where near ready to return to work infact I have my last one on the 12th feb. I have heard some really bad stories about the tribunals so was just wondering how you felt it all went??

Sharon30, try not to worry too much, the Tribunal is completely different to your medical or Jobcentre interviews. The panel will understand that you are nervous, they are completely impartial and they will not do anything to try to catch you out.
If your representative is not able to represent you, it would be worth asking them to come with you to CAB or Welfare Rights to fill them in on your case, stops you have to go over it again.

The Appeal panel are there to make a decision based on the evidence you provide, and the law, not to cross-examine you.
They will be very grateful if you have your bundle of papers with you with all the pages in the right order, and an organised list of points you want to make. However some suggest not being too organised or well-turned-out. If you can take someone with you, even a friend who does not speak on your behalf, it supports the idea that you need someone.
If you are claiming on the basis of mental health do you have a copy of the mental health descriptors and scoring? These used not to be given to applicants under IB, not sure if ESA is different.
Also there are claims that the descriptors list used at the ATOS assessment andon the ESA50 is different from the law. The law ones prevail.
Questions at the ATOS interview like, for example "do you go shopping on your own" will be taken to mean that you have no problems leaving the house; you can respond that you have to go shopping because there is no-one else to do it for you and that sometimes you do not have enough food in the house because you can't face going out... etc. Then you can get the point for "not going out".A kind word lasts a minute, a skelped erse is sair for a day.0 -

l must say l was a nervous wreck for about 2 wks b/4 l to suffer v badly with depression/anxiety you know whats its like "pull yourself together" ect anything physical u get all the sympathy.. mental heath . steer clear :mad:
l found the 2 people [men] at my tribunral were v kind , gentle,
like l said in an earlier post , answer Q as if its your worst ever day. cos most days are just that !! l must say that on reflection the gp on the panel did seem to b goading me to lose my temper but just be your normal daily self there,s plenty of tissues on the table for you :rotfl: by the time they,d finished mine were shredded over the floor , and the neck of my bottle of water had turned into the gps throat asking Q that seemed stupid to me but relevant to him

As I said on the other thread you should NOT answer the questions as if it is your worst ever day as this could give a very false impression. It should be an average or typical day.0
