i'm not sure this the right place for this thread? my ex partner is trying to take me to court to sell the house we used to live in. i went to see a solicitor today for advice only to be told that i am not eligable for legal aid as i work full time and that it will cost me £5000 or more to have a proper go. i do not have £5000 my ex pays no maintence for our daughter. any suggestions please?

Do you live in the house? Does your daughter? How old is she? As far as I know (and I am not a lawyer) your child cannot be forced out of the family home. This would mean, I assume, that a court would look at the house as the child's long-term home, and would not impose an order to sell until she is an adult or not financially dependent upon you. They might also take account of her fathers lack of maintenance payments. Why is he not paying? Can you afford to stay in the house?0

He can't force you to sell if it's the child's home, but perhaps it would be worth selling, so you can have a fresh start without having a link to an idiot who puts money before a roof over his child's head!?!
