Should I close my account - will it effect my claim?

Hi,

Alliance and Leicester are trying to take £95 from me for going slightly overdraft for 19 days. I am a student and they have already robbed £50 from me for direct debits they apparently paid on my behalf when I didn't have enough in my account.

I have told them I can't afford to pay it, I applied for hardship and they still refused.

I took all the money out the account when I discovered they were going to charge me £95, but I don't have an overdraft and they won't give me one so when the charges take effect I will be charged an extra £5 per day!

I have read that the charges need to take effect, and then I will pay them to stop it escalating, however should I close my account after I have paid the charges or leave it open - will it effect my case when I complain to Ombudsman?

  • Do you not have a student account with Santander/Alliance and Leicester because those £5.00 charges should not apply to student accounts and you should have an overdraft facility on there. Are you at university or college?

    I am at university and the account it a premier account so its not a student type. I did apply for a £250 overdraft but it was declined, strange that I have a £1250 overdraft on my student account with Barclays!

  • Did you ask them at any time to refund charges as a gesture of goodwill or was this a separate occasion?

    i have previously been charged £75 from 3 DDs being paid by them, of which they refunded £25.

    I have received a letter saying that they are not willing to pay the £95 because of this previous gesture of goodwill.

    Is there anything else I can do or do I need to apply to Ombudsman, and should I close my account or leave it open once I paid the charges?
