To be honest i applied for dla about 8 years ago and a doctor visited me and because i could stand at the cooker and make myself a meal it was declined. I can still do this although i cannot use a bath properly having to go to my brothers house for a shower, i had a bath when i first moved into this flat and it took me half an hour to get out and that was by rolling out of the bath onto the floor, but i can still stand at a cooker so there is no point in re applying for dla.
im off to the council to inform them of my change in circumstances, thanks for the replies so far.

Being able to stand at a cooker does not mean you cannot claim DLA!!

There is a number of factors.

I know someone who receives higher rate for both and can stand at a cooker, and I've received it in the past while being able to 'stand at a cooker'.

But can you actually cook a meal? I can stand at a cooker; but I can't peel or chop safely.

  • you aren't going to lose anyhting (except some time) by applying again.....
  • I know someonre who gets DLA who is always cooking and baking. This is not the only criterion. It depends on how your particular disability affects your everyday life and hw much help you need with it.

The person who I know has an invisible disability that does not prevent her cooking a meal but does cause her problems in other areas of her life.

So it might be worth re-applying for the DLA.

  • I think you need to rethink the DLA very seriously and get full advice.

The lha for this area is exactly the same as the monthly rent so its not that and i only got the letter this morning about the income support as i claimed a week or so ago. The reason given by the council is that and i quote "its because you are on incapacity benefit, if you were on jobseekers or income support it would be different" . The same thing happened when i tried to get help with the deposit. I have been told by a lot of people including a solicitor that incapacity benefit is classed as an income not a benefit. Very strange.

    thats because I/B is taxable

Thank you for the replies, my original injury was caused by a 40 ton digger hitting me on the head (was wearing a safety hat) apparently my spine was compressed.
and i can assure you at the time i applied for dla the doctor who came round on a saturday asked me a lot of questions, filled in a form and left after 10 minutes. The reply i got said i didn't meet the criteria and specifically mentioned the fact that i could stand at a cooker to make a meal.
I will reapply and see what happens epecially as i have to go to my doctors monday as for some reason my knees keep giving way.
I have been to the council but will have to wait 10 to 14 days for them to sort out.

Hi again, just received a letter from the council, it looks like i will be getting full hb and tb in the future. Just like to say this site is very good even with differing opinions it still makes you want to try and sort things out rather than giving up.
