    You may have paid for the clamp release but you can claim it back plus interest and costs, in a Small Claim against them and whoever contracted them. So yes, you SHOULD be taking them to Court, but you also need to name whoever contracted them there or you will never be paid even if you win in Court. Sue both parties for the clamp release fee and interest and your costs, it is not as difficult as it may sound and you do not need a solicitor.

    Have a look at clamping cases like yours on pepipoo forums, where people are in the process of taking clampers and landowners/occupiers to Court for their money back:

    But as far as the fake PCN is concerned, like everyone else here you must ignore the ticket and any letters that follow. They will threaten Court Action but they will in fact just give up if you ignore them. You owe them NOTHING and it will come to NOTHING.

    Do not even think about paying that 'ticket' or contacting them about that ticket - just sue them regarding the clamping. :D

    Ignore the invoice, but if you park there regularly I would be careful. Clamping for unpaid invoices is illegal, however it may not stop them doing so.

    Have a look at your clamping situation, although it is actually legal, or should we say allowed. Not many companies fully comply with what would make it legally tight.

    Vally Enforcement (VE) have given me ticket for parking in a small car park of a closed diner on a industrial estate during the weekend. I parked there because the tile shop beside the diner where i wanted to go, cars were blocking the entrance to this car park. It is also monitored by VE. I have looked on a couple of forums and they all say to ignore the ticket. As the car is a contract hire car via the company i work for do you think they will go that far to trace the driver.:cool:

    The times i mentioned car park what i really mean is a few spaces in front of each premises.

    Ignore the PPC, Valley Enforcement and never mind the circumstances as their modus operandi is a scam. They send out a series of debt collector letters which can look scary if you believe the rubbish in them!

    BUT your biggest headache is that this is a company car. You MUST convince/tell your Fleet Manager AND the company they hire the cars from, that this was a fake PCN and not to take the letters seriously that they will receive about the scam. Put it in writing or in an email, with links, on Monday and never mind the circumstances - there was no offence and it's actually your business as the driver, NOT theirs as they are not liable at all.

    Secondly, to show your Fleet Manager that it really IS a scam (cos he might not believe a load of strangers on a forum! :D) show him this link from Fleet News:

    Send your Fleet Manager a linky to the episode with the solcitor and the paper aeroplane.

    I say you must act on this NOW to make sure that no uninformed person in your company or the car hire company stupidly pays the fake 'fine' and tries to charge you. Do not let them pretend that your contract allows them to do this - see the pepipoo thread I first linked and you will see that almost all such contract mention only 'parking offences/penalties/fines' which come from 'Police/authorities'. Your fake ticket is NOT a fine and comes from no authority at all and I would suggest that to make you pay for a scam 'breach of contract allegation' - which is no 'parking fine' and no business of theirs as ONLY the driver can possibly be liable on private land - would be unlawful.
