Legal right of access over neighbours drive
Comments
-
The reason that this has become an issue is that my neighbour has recently purchased a dog and even though they have a fully enclosed big rear garden would like us to shut the gates between our property and theirs to disturb their dog less. They cannot let the dog loose in the driveway anyway as obviously we can open the gates at any time to access our property.
No offense but I don't think its up to you to say where or where not they can let their dog roam on their own property.
Also you have a right of way BUT I think you will find you have a duty to ensure you neighbour doesn't suffer the loss of his dog because of your negligence. Not Again0 -
Perhaps they are concerned that if you leave the gates open then the dog might be able to access your garden. It's prolly more for your benefit than theirs. Possible?

In my (somewhat limit) experience of things of this nature. A neighbourly chat over beer/tea/glass of wine can sometimes head off a lot of legal nonsense and bad feeling. Shutting your gates for a continued harmony may be a tiny price to pay.
Find the reasons behind it all first before you adress what your legal position may be (although I'm all for being armed with correct information beforehand).0
