Car insurance rage

My daughter's car was hit whilst parked in a layby and was written off.
Other driver said he'd blacked out and so his insurance won't pay out.
Her insurance has settled on her car but she's left with a big excess to pay (she's 22) and hire car charges. Also she's lost her 2 year no claim bonus and her settlement pays of her car finance but leaves her no money for a new car. How is this fair???? Any suggestions as to what I can do??

I certainly hope the other driver is never permitted to drive a vehicle again on medical grounds - if he's admitted blacking out while driving his licence should be taken off him.0

It depends on if it was a one off blackout,if so the insurance company should payout because it was an unforseen event(accident)
if the other driver has a pre-known medical disorder then yes his licence should be revoked,
ask your insurance company to confirm either wayIMOJACAR

Quite frankly if you have a black out behind the wheel and smash into a parked car I don't think it should be put down to a "one off" and left at that - a healthy person with no medical complaints will not generally go from fully concious driving a car to having a blackout. Could've mowed down a dozen children0

It's the other way around, unless the accident was unavoidable eg the person had no history of blackouts common law does not make them liable. If however they have a history and say had not taken their medication or insulin etc then you would have a case against them.0 -

If she wants another car she can get finance for it (thus in the same position as she was before the accident).
Would have been the same situation if her car was hit by an unknown driver, and something all drivers should be aware of, regardless of age.I was born too late, into a world that doesn't care
