Bank charges - Nationwide

Hi,
Can someone direct me to a thread/info regarding the test case and what to do?
I had started to pursue getting my money back for charges, sending Nationwide a LBA. At which point the test case went before court and subsequently an unpopular ruling has been given.
Is there anything else I can do to recover these costs and also to remove the smudge on my credit report?
I only had a cash account (no debit card/cheque or overdraft facility) with Nationwide, so I am surprised they record details with Experian.
