I wondered about the ringer scenario as well. Is Perky married to or related to a Michelle?
After asking pepipoo for advice about 'wording her defence carefully' - and she had lots of points which should have killed the case stone cold in her favour - she seems to have just concentrated on who was driving.
She wasn't driving but the judge still allowed the small claim in favour of the NHS trust - which is similar to the Stephen Thomas case where his only appeal point was concentrated on the assertion that he was not driving.
If she wasn't a ringer, then I apologise sincerely to her and hope she realises that she now has the chance to get this overturned in the Court of Appeal which would be a wonderful result.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It does seem that her defence was weak despite all the advice she got, and chose not to use, from the "experts" on pepipoo.0

As far as I can see, (may have missed it) she did not show her case on Pepipoo and there were more strands to her argument which she did not use.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

PPC troll on Pepipoo hinting at BPA involvement. Clearly there is more to this "win" than meets the eye. Coupl;ed with the apparent failure to mount any realistic defence, looks more and more like a sham case. Very easy to do if you are so inclined.0

This changes nothing. Firstly it is just not cost effective for a PPC to take every non-payer to court, so they have to be very selective.
Someone who has never communicated with them increases the odds of ever being taken to court.After all you may be a barrister with a chamber of free expertise, just laying in wait for a PPC court summons.
Secondly, as this and other cases have shown, you are more likely to win a court case than lose.0 -
Reading through the post on pepipoo, it looks like that it was NOT a PPC that took the woman to court, but the landowner itself - in this case a NHS trust - albeit through solicitors.
The second observation is that the amount of money requested was in the order of £100, not the £500 or so often bandied about.
Both of these could have swayed the judge.
I do hope that she appeals, however re-reading the post with the thought that "Shelley" could well be a ringer as suggested above does make me wonder - despite all the generous offers of legal and financial help for an appeal, she has not posted since.0
