Redundancy/Demotion/Protection

Hi,

In the following situation what does protection mean? There are three members of staff currently employed. One is to be made redundant as they're on a temporary contract and it is expiring. A different role is to be created that the other two are to apply for. There will be three years protection for the unsuccessful candidate.
Does this mean that a job will be found for the unsuccessful candidate to do for three years? Does it mean that the salary will remain the same as they are currently on?

    Sounds like the unsuccessful candidate will remain in the original role guaranteed for 3 years on the same terms with the successful candidate filling the new post no doubt on new T & C.

    So the new role will likely be paid more and include the duties of the person on the temporary contract possibly?

    The other thing I don't understand is what if neither person wants to apply for the new job, would they then be made redundant?

    I also don't see how the company benefits from this as by the sounds of it the two remaining people are going to be on the same money as they are now, the only saving will be the third person who is on the temprary contract.

    In my company protection means that whilst you may do a lower grade job role ( yeah right) your money will be protected and remain at the same rate of pay

    There seems to be some confusion here or I have misunderstood the situation.

    I fail to see how someone whose 'temporary contract' has expired is deemed as being in a redundancy situation. The contract has run its course - end of story.

    If a 'different role' is to be created for the other two affected personnel, that suggests the role they are currently employed in is to be made redundant and the remaining staff are to apply for the new 'role'.
  • Hi, I guess that the person on the temporary contract isn't being made redundant then, just being let go.

    In any case, the rest of the info is correct, the new position is for the two remaining people to apply for with the unsuccessful candidate being protected for three years.

    If the protection means the candidate would get a lower paid role but remain on the same salary could they lower the persons hours and pay them at the same salary but pro rata or does the protection mean that the person has to be paid exactly the same ammount?

    what jobs are being offered as replacements
    Are these suitable alternatives or not.

    We can only guess what your employer means in this case.

    I can't really find out any more info at the moment.

    I know that there are currently 3 people. One is definitely leaving. It says there will be new roles (plural) created which the remaining two people can apply for. It then says the unsuccessful candidate will be protected for three years. As it stands now both peoples roles are equal but this suggests that the new roles may be a better role and a lesser role with the unsuccessful candidate getting the lesser one. They will then be protected for three years.
    I guess it's more than likely a positive thing.

    It sounds to me

    Temporary Contract being terminated - no replacement
    2 Permanent Contracts - one will be promoted. The other will be demoted although will receive the same pay etc for 3 years after which they will not.

    The person demoted is likely to be able to argue the new job isnt similar and hence be made redundant. The person promoted could probably as well but wouldnt likely too

    It will be for the demoted person to decide whether they want to take redundancy or take a lesser job for security.
  • OK cheers, that's what I was thinking it would be. I guess taking a lesser job for the same salary they are on now wouldn't be too bad. At least they'd have a job and still be taking home the same money.
