itsakidsworld sorry if have offended you, i suppose i just wasn't expecting someone to be so blunt about the situation- i do try to see it from both angles but because i'm very emotionally involved i find it very difficult.
I was originally going to accept an offer for him to buy me out but it has come to light that he doesnt actually have the money to do this so looks like we will be selling.
The mortgage has been in place since december 2003, the monthly payments wers £290 i think and have recently gone up to 307 and my ex has been on a payment holiday during this year for 6 months, don't know if that's important?
im not sure what type of mortgage it is what is the difference?0 -

No worries and no need to apologies.
Based on your figures you will be left after all costs with about £26000-£27,000.
What you decide to then split with your ex is your own personal choice as you are an equal party here. He could contest that he has paid the mortgage for the last two years and a court may award him an additional sum for this. So you do not want to go down this path as even if you won, the legal costs ( and additional stress) would just not be worth it.
So make him an offer in writing that you will agree to him receiving 55% of the final balance and you 45%. This 10% difference will be more than sufficient and is a very good proposal.
Incidentally this almost tallies with what you stated in your very first post so well done to you for being on the ball.
Stay strong, stay focused, nobody can see your fear so never tell them you have any!! But please act quick or the situation could change fast with payments being missed.
