Fraudulant Fitness First membership

At the beginning of November I approached Fitness First to enquire about a membership. The company I work for has a corporate membership arrangement with them so they requested their name to validate that I was intittled to one. The gym offered me a free month as I already had an excisiting membership with another gym. I left saying I would discuss the offer with the corporate membership consultant. She informed me that since the costs were already subsidised I could not take advantage of the offer so I left the issue alone. I have this in writing.

The following month my other membership expired and I again enquired about a membership. This time I was informed that a membership had already been taken out in my name and was company was invoiced and paid (The gym had informed them I had joined). I managed to get a copy of the contract and neither the handwriting nor the signature was mine making it a fraudulant contract. I informed them of this but nothing was ever done. They are now saying I am still responsible for the months of Dec and Jan as I never cancelled the contract. I don't acknowledge that the contract is valid so I don't see why I should have to cancel a contract I never took out.

I have reported the matter to the police, got a case number but due to the small amounts involved they're reported it as a crime but are not investigating it further. I have also writen to their Head Office but my complaints have been ignored. I am unsure what further steps to take to get some form of apology and remuneration. Taking the matter to court is also not a possiblity as again the costs don't warrent it.

Anyone have any suggestions, and does anyone know if I am responsible for this contract despite not asking for it or cancelling it.

  • If the choose to try to enforce payment, they will need to get a county court judgement against you. This may prove difficult if they have forged your signature on the contract.

    Have they taken any money from you or the company you work for? I would start by sending them a recorded delivery letter giving them 14 days to return that before asking for an apology as getting your money back will feel better than hearing from someone who's been told to apologise.
