Barclays bank charges:No refusal letter yet?

I filed a claim for a refund of our bank charges (approx £4000) but unfortunately the timing was out; the deadline for them to reply to my letter was about a week after the court hearing. I still have not had a letter from Barclays to tell me that they won't be refunding the charges. I was thinking of reapplying under the Hardship rules, and by quoting from the lending code, as I feel that the bank should have offered us other solutions to our financial difficulties rather than simply charging us fees every month and raising our overdraft when it was clear that our income had reduced. Do I need to wait for the refusal letter before I reapply? Or should I just reapply anyway? Thanks. (Especially to "natweststaffmember" for posting the lending code on here)

Have you read part 137 of the code? It states that the even thought the onus is on YOU they can do things as well. What have YOU done to deal with your hardship?
have you contacted the priority creditors to try to arrange something to help you through the period of financial hardship?
You have to read the code and then do the groundwork. The problem is that just stating they should have done more is irrelevant unless you have done something as well.
