Late Licensing Penalty

Hello
I sold my car on 26/08/2009 and the tax ran out on 31/08/2009. I sent the log book off and thought no more off it, due to Christmas I didn't realise I hadn't recieved the confirmation letter until I got a nasty letter saying I must pay £40 for not declaring it SORN. I then rang up to check what the details where and they still had mine. So I wrote to my local enforcement officer explaining the situation and have recieved a letter stating
" I understand you are no longer the owner of the vehicle and that you are in possession of an acknowledgment letter. However you were the registered keeper of this vehicle on 01/09/2009 and it was not relicensed or a SORN made when required or when requested.
Consequently you are still liable for the £80 penalty.
What are my rights, I think I can gather from numerous phone calls that the details finally transferred over at beginning of Jan.
