notice to quit business premises

Hi, i wonder if anyone can help me with something i know nothing about. My brother has worked for himself for the last 6 years. Now due to a couple of factors he is having to give up work, mainly due to the fact that his wife is very ill and needs constant care.
His lease for the premises is up in April and he has given notice, he has been told by the landlord there will be a charge of approx £1500.00 depreciation charge, which he wasn't expecting but is ok.
My reason for posting is the rent is due on the 1st of every month, January's rent was 2 weeks late, and the landlord threatened to throw him out because of this, he has since paid it but he is already been contacted by the landlord for next months rent (Feb 1st).
Of course i know rent must be paid i'm not arguing about that,but again it may be late as his wife is going through a very bad patch so he's not earning, its just that his landlord has told him he doesn't need to give him any notice to get out for none payment of rent, even if only a few days late. I have gone through the lease and there is no mention of notice on either side. any advice would be gladly received

    Is your brother a member of the Federation of Small Businesses? If so, he can get some free legal advice from them.

    If is wife is ill and needs constant care would it be better if he got someone into care for her that way he neednt give up his business and have to rely on benefits or savings? Just a thought.

    I very much doubt the landlord can just kick him out for late payment of rent, I'm pretty sure he would have to get a court order but if you speak to a solicitor they will normally give you half an hour of their time for free, that might be enough.

    '£1500.00 depreciation charge' - is this in the lease? if not I'd query it.
