    Until the supplier has accepted to physically dispatch the order, there is no contract for them to adhere to. I would expect any seller to identify their mistake and inform you accordingly...

  • Why not just cover the possiblity in your Terms and Conditions? Incorporate the T&C into your standard contract (available on the website) and your fine.

    Something like " A contract has not be formed until the goods are dispatched."

    When we asked trading standards about a similar issue a while back they said we could put the following in our terms:

    2.1 The Seller has the right to cancel the Contract if:-
    2.1.1 The Seller has insufficient stock to complete the order;
    2.1.2 The Seller does not deliver to the Buyer's delivery area; or
    2.1.3 Any of the Goods were listed at an incorrect price due to any error.
    2.1.4 The Seller may choose not to accept an order for any reason.

    This seems to cover most eventualities and complies with trading standards.

    This is ideal, but can be pretty expensive on something that can be worked out online, or found through numerous Government agencies.
