What happens when a solicitor takes you to court for nonpayment???

    And are you sending payment anyway by recorded delivery? Courts look much more favourably on those who make every effort to pay their debts.

    You need to get your brother to make staged payments to you, you don't necessarily need legal representation to do this as the court has already ruled that your brother should pay your legal costs.

    As my solicitor says, with the wording the judge had said, it means that I pay first then go to court again to get it off my brother. So yet more expense in doing this.

    I havent made a payment the last few weeks but when I do try ( I used to go to the offices with cash and obtain a receipt) I get refused now as I can only pay small amounts each week as I dont work.

    I will have to send those amounts in as a cheque by rec del, at least if they refuse to cash it surely that will go good for me when it gets to court?

    I am unable to see my brother as he has been warned by the police to stay away from me as he once kicked my door in to get to me, lucky for good secured door, as I said previously, he is pleading poverty, he has 3 kids under 16 and his partner just left him.

    I have a one year old but my solicitor seems to be overlooking that

    Regardless of any costs order made by the court the contractual obligation to pay remains with the client (in this case the OP).

    This should really have been explained to the OP (and may well have been as far as I know).
