Working Time Regulations state for rest breaks and cater for night workers. Have a look on business link.

It depends, in so much that by law you are required to have a 15 min break every 5 hours, however if the employee chooses to work through then that is their choice. :-)

Rest breaks are actually 20 minutes for 6 hour work.

Under normal circumstances you are not allowed to work continuously for 24 hours. There are provisions for minimum rest breaks every 6 hours and for longer periods (e.g. you should have at least 11 hours rest between working days).

    Have a look at

    Hi,
My brothers wife works in a school, and every so often they stay over, And she as said that she will do it on friday as they need the money.
My brother is not very happy about it, she will drive to work which takes her approx 30mins to start work at 8-8;30. she is in school till approx 3.30 then she starts her next shift which she is doing a wakeing night and will finish about 7.30 sat morning, Then drive home which is a very busy rd. He thinks this is wrong and its not safe. and as asked if there is a law against this. And to be honest i have to agree with him, certainly about driving home after such a long shift.

    William.

  • So 8:30am - 3:30pm... then when does the next shift start that ends at 7:30am? Is it straight away? What does this night time shift involve?

It sounds like she's not being forced to do it as you've said she wants to do it for the money. Why doesn't your brother pick her up on Saturday morning?

From what you've said, it's almost certainly unlawful. You can contact the Pay and Work Rights helpline on 0800 917 2368 for more advice.

What time does the second shift start?
No it's not unlawful if you choose to work it, but H&S has to be addressed. I used to work longer than 13 hours, quite often.
And there are excepted jobs that let you continue working as well.

There are special rules covering this type of work, but even if it does not contravene the Working Time Regulations (which I suspect it does), it almost certainly contravenes Health and Safety, especially, but not only, if she is alone for part or all of the night shift.
