    To me this sounds as though your employers are picking at sttraws in a bid to make you redundant without having to pay you redundancy pay. This is the oldest fiddle in the book, blame the employee and save the company some money! Be careful here, of course it does depend how many days/hours a week you work as whilst the time you have had off sick doesn't sound particularly bad to us full timers, if you only work a couple of days a week then proportionately this is quite excessive sick leave. Do some digging, is the company in trouble? As I have said, they may be needing to make you redundant but cannot afford to actually do so and so have created a 'misconduct' so that they don't have to pay out. When you were off sick did you always provide a doctors note/certificate to confirm your migraines etc? Any evidence such as this will be very beneficial to your stand point.

    It was doctors notes most of the time but bear in mind the last 2 stages were 3 days each and 1 absence of 2 days and a single day.
    i was on 26 hour contract 5 days a week.
    They do need to save money in our office as manager has overspent his budget (he blames 2 staff on mat leave?).
    I will go to tribunal if i have to and explain RM's unfair absence policy, some of the wording of the policy isn't very clear.

    Just a update.
    had the dismissal interview on the 4 feb 2010 and it took the area manager 4 weeks to decide that i was being dismissed with 7 weeks notice.
    I have put an appeal in the day after the interview but that could take up to 12 weeks apparently, RM's in a right mess at the moment.

    Can you afford a lawyer? If not citizens advice is next best I would guess.

    The person who i spoke to was a proper ATOS DR, but how can a telephone consultation help when my GP knows my condition.
    I have a copy of the docs report and it wasn't too much i my favour as in one sentance states that i might not be covered under the DDA act then next states that the condition might be cleared up within the next 2 years, how does he know!!!!!.

    They probably use LIMA, the same software the DWP use (and own, and receive royalties for its sale/rental to other unnamed firms)...

    Just out of curiosity, have you informed the DVLA of your condition?

    The reason I ask is that it may just provide your employer further ammunition to fire at you, however, if you have had clearance to drive, this may just strengthen you situation.

    I am unsure if this condition is notifiable, however, I would suspect this would depend on the severity of the attacks but I would attempt to cover any eventuality that your employer may throw at you.

    What seems apparent however, is that RM is a horrible employer.

    Do you have a free law centre near you?

    If the local uni runs law classes they often have a free law clinic. This is run by students--but under full supervision and they are all up to date and very keen.
