Redundancy Notice Period

On the 10th December 2009 a meeting was called that the whole company (22 employees) attended. In this meeting we were informed that all employees of the business would be placed at risk of redundancy and that this would be the start of the consultation period (due to xmas shutdown would continue until the 21st January 2010) at the same time it was asked if all employees would take a 10% pay cut to hopefully mitigate the need for redundancies.

The 21st January came and went with nothing been said (no meetings and nobody knowing what was happening) due to this the consultation period was then extended by email on the 22nd January until February 5th.

My apologies for the garbled post but my question is: does my notice of redundancy begin when/if i am selected for redundancy or when the consultation period commenced?

  • Notice starts at the end of the consultation period, in your case 30 days as there are under 99 people affected. During the consultation period details can change, and therefore it is not possible to serve notice during this period. Hope this helps.

    Please note that redundancy pay is based on the most recent paylevel (ie I think its based on what one has earned in the last 12 weeks??).

    Hmmm....wonders if they've managed to push through that 10% paycut and are now looking for excuses to keep their employees on 90% salary for JUST long enough (ie that 12?? weeks) in order to be able to base redundancy pay on lower salary than they actually normally receive IYSWIM.

    They could be "playing games" - watch them carefully....

    Ooh my head hurts too much to start figuring out dates right now: 10 December + notice period time. Hmmm....say its 2 weeks notice due for most of their employees for example...Hmmmm....2 weeks notice period + 10 weeks = the 12? weeks I mentioned....that would make the date that things "start moving" again...couldnt find my calendar.

    Maybe thats just my cynical mind working - but I would be keeping an eye on the date 12 weeks from 10 December and thinking that they will say something else that "notice period worth of time" before "12 weeks from 10 December" IYSWIM. Maybe thats just the way MY employer works - but maybe yours does too....
