Toshiba laptop

I paid £350 Toshiba Satellite Pro from EBuyer in September last year and I'm on the verge of sending it back for the third time.
In December, the laptop died during a Windows 7 upgrade, and the hard disk and mainboard were replaced under warranty.
On return, the battery wouldn't charge and the mains adaptor would only connect intermittently. Once more it was sent away and repaired under warranty, again replacing the mainboard, ac input socket and mains adaptor.
Now I've received it back again and it seemed to work fine on the mains, but trying to boot from battery either renders the machine totally dead, or the inital Toshiba screen appears as either horizontal lines or a tartan effect, rapidly getting brighter and brighter, and failing to get any further. I then have to remove the battery and connect to the mains, from which it boots normally.
I can't fault the Toshiba tech support, despite being an 0844 number I've got through quickly and the staff seem to know what they're talking about - there's been no quibbling and a courier pick up has been arranged both times for next working day.
However, the unit has to go to Germany for repair, which can take around ten days.
Question - can I demand a replacement machine or equivalent as I believe this laptop isn't fit for purpose - and would this be taken up with EBuyer or Toshiba? Luckily I only use this for home use, and not work otherwise I'd be a bit peeved by now. Nice laptop when it works, though!
Can I also demand a warraty extension to iaccount for the time it's been away?

It would be up to eBuyer to ask for replacement, but they can repair it again.
