Phone contract illegal or not?

Hello all,

I'm a newbie to this site but looking for some advise, not sure if I should be posting this thread under 'Phones'?
My wife and I now have a new addition to our family. With that in mind we seriously need to watch our out going costs as she is now on maternity leave with standard pay.
With this in mind I recently rung my wife's mobile telephone provider to cancel her contract.
After ringing Vodafone we have been told that it has been renewed for another two years!!
This is news to us, they have advised that this has been renewed via an external 3rd party reseller and we are unable to cancel this contract.

I must stress within the five years my wife having this contract, we have not renewed. With that in mind, we have never been approached nor received any phone upgrades etc.
Surly this is against the law, should they show us a signature of some sort as all they said is they only have notes?
Has anyone else been in this predicament, I've searched Google but to no avail.
BTW – Many thanks to this website I've so far saved £££ on heating, insurance and food!!.
Just this left to sort…:mad:

Any advise much appreciated.

    What does your contract say? only that will determine if its legal or not.

    I will say thought that my contract (and the ones before it) all auto renew but on a monthly basis, so i can cancel whenever with a months notice.
    Back by no demand whatsoever.

    Im with vodaphone and they have never renewed my contract without telling me - just need to give them a months notice if i ever want to cancel it (...if a 3rd party reseller involved surely they would have had to get authorisation also?) Id ask them for a copy of the paperwork and see what they say.

    If you never renewed the contract and never authorised the autorenewal, then there is no contract. You now have to write to them keeping copies and ask them to provide proof of contract and tell tehm that the contract cannot be valid as you have not authorised it. I suspect the 3rd party has claimed a hefty commission at your expense.

    My thoughts too - I wonder if the original shop where the phone was purchased has been renewing without the OP's permission and claiming the commission?
