criminal compliance

My case was sent off to the criminal compliance team 3 weeks ago as the csa are planning on taking my ex to court, but at the moment they are not 100% sure of his address so my case worker said that someone from criminal compliance would visit the address i gave them for my ex to check he does live there so they can be sure when they send out a summons for court, i havent heard anything in the past 3 weeks and was just wondering how long i should give them before i start chasing it up?

  • My case has been with criminal compliance since August and they are now hopeful of some kind of outcome in the next couple of weeks. I have spoken to the investigator a few times in the meantime and it usually how long he has been bailed for and then I hear after he has been in for another interview.

I have a feeling mine has been with criminal compliance for a long time now. I dont think its anything to do with crime at all.

I thought this was all about criminal law and I argued that the CSA made false representations about my circumstances to obtain a higher money transfer than they would otherwise take, an offence under section 2/4 of the Fraud Act 2006.

It turned out the CSA might be exempt from criminal liability, the moment the CSA mentioned the word "criminal" they made idle treats I was a burglar or mugger and could be arrested with both passports seized at the airport the moment I stepped off a plane in the UK.

I wrote to the UK parliamentary ombudsman enclosing a copy of the CSA telephone conversation on a memory stick, but that didnt yield any positve results. I've never been "arrested" by anybody. It was however, instrumental in getting a REMO application struck out in France, the CSA has no laibility when it fails to comply with its own rules, even the French judge smiled at that one.
  • spoken to the csa today and been told it wont be long until someone from the criminal compliance team takes a letter to my ex at the address i gave them for him, i did ask what they would do if he wasnt in on the day/time the turn up and was told they would keep trying, but they couldnt tell me how many attempts would be made, anyone got any ideas? i know that when the bailiffs were involved they only visited 3 times, so surly there would be some limit on the amount of times they try? and if so what would be the next plan of action?
Its so frustrating because i know he lives there.

Also my ex is working self emplyed and hasnt registered his business so there for there is no real proof that he is working, but he has gone and got his van sign written, if when it goes to court and my ex denies that he is working (which he will) would photos of his van help prove otherwise?

yes, get all the evidence you can.... if friends see him working get them to take pics too, make notes of times, dates etc. What does he do?
Would it be possible for some to get a written quote for some work, that would be more proof, or receipts of work done.
If he's not working, then how is he getting by? Is he claiming benefits? we al know you can't live on nothing!!

    Good luck!

  • he's doing window cleaning, painting and decorating etc, there is an old peoples home directly opposite where i live, he cleans their windows, so could give the name and address of the place to the csa, hadnt thought about getting a friend to get a quote from him, thats a good one.
there are some pictures on his girlfriends facebook profile of him standing next to his van just after its been sign written, but not sure if i can use these as they are on her facebook profile, or if i would have to take some pictures of it myself

Why are you tracking him on facebook?
  • Im not tracking him on facebook, a friend of mine is friends with his girlfriend and said there were pictiurs of him standing next to his van on there and im just asking if those pictures can be used or if i will have to get the pictures some other way.

I'd use them!! He's the one in the wrong by working and not paying tax or child maint! Isn't facebook and all of it's photos a public social networking site. If his girlfriend doesn't want her photos available to the public domain it is her responsibility to change her privacy settings? Get them printed off before she does this.

I only wish my ex husband was clever enough or had enough friends to warrant a fb account - then perhaps he'd shoot himself in the foot too and make my life easier getting evidence of his cash in hand work that he does!

    Good luck
    Expect less and get more...
  • Ive got the pictures off her facebook and they are stored on my comp now, just waiting for my case worker to get back to me so i can email them to him,
Personally i wish i didnt have to do this but the case has progressed so slowly (which considering where he lives in relation to where i live is a complete joke) im at the point now where im willing to try anything i can to speed it up.
