These things are quite complicated and can often get quite messy. Also if you don't play by the book then often things can end up even worse for you than they are at the moment. I would suggest you get advice from the Citizens Advice Bureau. You're local bureau will be clued up on Scottish Law and be able to advice you on the best course of action to take and how best to cover yourselves in this situation with regards to selling/throwing his stuff out.

You've not mentioned where in Scotland you are but in Edinburgh there is an organisation called Letwise who were very helpful when I rang then about tenancy issues.

The OP should see a solicitor with housing law knowledge or find a scottish landlord forum.
Most organisations that give free expert advice to tenants do not offer advice to landlords.0 -
