Letter to Lloyds - Charge Them?!

I need to reply to yet another letter from Lloyds TSB about trying to claim my charges back from them, and my OH said, "are you writing to them again? You should charge them per letter"... has anyone actually tried sending them an invoice for writing to them? I am tempted but at the same time, don't want to jepordise any potential refund!

    Next time the OH says that, ignore her cos you cannot do that and the contract does not allow you to.
    Furthermore, I would await further advice from MSE when they publish their reclaims guide. We are starting to see how the FOS are viewing new arguments but we still need to see how the Banks are dealing with complaints in court.

    Lloyds will ignore your complaint anyways, or if you get a reply it wont be anything to do with what you have asked them or complained about - example, your complaint "I'm tired of writing to you only to have my letter and complaint ignored and not responded to properly, i would like my money back for the recorded delivery and wasted phone calls i sent to you time and again"

    Lloyds reply "We got your complaint and we assure you nothing like this will happen again, we see you are complaining about communication failures by us, firstly you need to phone our CS dept and secondly, where all letters reach us they must have a stamp on them, and as far as were concerned thats the way it will always be"

    Your reply "What the hell are you on about? This is my 11th letter to you, please respond to me with sense and clarity, can i have a refund for you wasting my time?"

    Lloyds reply "We recieved your complaint, and we have completed our investigations, the letters you send should be directed to us which we will then read and reply to ASAP, as for recorded delivery please bear in mind that it only covers prices up to £28, we hope you are satisfied with the way which we have handled your complaint"

    I didn't think the 'contract' allowed them to apply charges to my account while it was over the overdraft limit, but they still did it.......

    sadly the contract does allow them to charge you the charges. Now whether it is fair or not is another matter.

    Tell him not to suggest it. Unfortunately, the bank contract would allow this and has been backed up in the recent test case. Whether the charges are fair is completely different.
    Let me explain this, unless the terms and conditions of the contract allows for a charge to be made by the customer for writing to the bank then you have no right to do so. If the bank had made an error in the processing of items on your account and it lead to charges then you have the right of redress, ie refund of charges plus compensation where this has had a knock on effect. Unfortunately on a straight forward bank charges claim, there is no bank error so you have no right of redress in this manner. If you want to take the advice of your OH rather than someone who has been within the bank charges campaign for nearly 4 years then so be it but you will waste time and the cost of a stamp to find out that the basic principle is correct.
