I have a sneaking suspicion though that your tax code changes when you're made bankrupt so your employer might notice anyway when paying your wages... i COULD be confusing this with people who have a certain amount of self-employed income too but I can check.

At the end of the day, honesty may simply be the best policy and if bankruptcy is going to affect your employment then you might have to look at another solution, or look for another job (or as Choo says a change to your responsibilities in your current job!)

Thanks for the advice guys, i've done the job 8 years and never had a discrepancy with any of the rent i've collected so there would be no doubt for my employer about my trustworthyness (have i made that word up?).

If i spoke to HR i would have to come clean about who i was and which role i work in so not something i'm keen to do at the moment. I have checked my contract and there is no mention in there about having to disclose it to them. If i didn't tell them, would they ever find out?....our payroll is outsourced to another company so doubt whether any probing questions would be asked.

I'll be glad when its all sorted, i'm tired of it going round and round my head all day long!.

I think it has an "I" instead of a "Y" - but no you didn't make it up...

However it's not gonna be about trust, it's gonna be about red tape and bureaucracy. Rules is rules and although your boss might tell you the combination to his safe he might not be able to allow you to continue in a job you've done professionally and without remark for 100 years!

Again, with payroll, although it's outsourced and nobody's business, there may be protocal for people to follow that requires them to highlight or flag these types of changes... (there might not, but there's the rub!)

I'm sorry if i sound like I'm being negative, i'm not, i suppose i'm just playing devils advocate (but i realise you probably don't need MORE questions running around your head - you probably came here for answers!) If it's not in your contract then i suppose you can't get in trouble for not mentioning it but that doesn't mean it definitely wouldn't have an impact if people won't find out.

Have you tried googling this situation ie type in the word "bankruptcy" and your job title and who you work for. Might uncover something!

Its a tricky one as I am the same as Emos and cannot go to my HR as nothing is confidential and its a can or worms I do not want to open. Mess Mess Mess.

Nothing in my contract and I am wondering how my HR would find out in regards to my wages if my code is changed? I have tried searching on google but nothing came up. I deal with rents but do not take money, I am a Housing Officer and its more of a social based job but I am wondering if anyone found out where I would be left..

i can find nothing either but have emailed (anonymously - chicken!!) my HR department and hopefully they will clarify.

Taking cash is a tiny percentage of my job role but it is something that is expected so not sure how they could cut that out for me, then again if they take me down the route of trying to show me the door then i'm sure my human rights will be infringed especially as there is nothing written in my contract.

As if there isn't enough to worry about!!

Just a thought queenb, if you go down the B/R route too and our employers treat either of us unfairly then at least we could site the other case in taking action. Are you anywhere near the midlands?, would be spooky if we both work for the same organisation?

Thanks again everyone for your help.
  • :) - sorry that made me smile there - it would be spooky wouldn't it if you did end up working for the same organisation ... the fun of anonymity eh?!

Emos - I hope you didn't take offence at my mentioning the problem that might arise due to you collecting rent - I'm sure no one would contemplate questioning how trustworthy you are but as Charco says "Rules is Rules" or should that read "Rules are Rules" lol

Queenb - it would seem that things are slightly more straightforward with you as no money involved, so shouldn't affect your position at all ... no-one is going to write to your employers to inform them - main problem now would be if you came across someone in court that you KNEW.

Emos - you might be on to something with the fact that your Terms of Contract does not stipulate bankruptcy having any effect on your employment ... nothing chicken about emailing HR anonymously. If you don't feel you could ask something discreetly in person or via telephone then this appears to be the only other option and it is a question that needs to be answered before you can make your decision (and I for one will look forward to reading the response as I'm sure Queenb is too :))

    Hi

Well, have had a reply back saying that it wont affect my employment but they would prefer me to let them know if i do end up taking B/R route, so at least thats sorted!!.

ChooChoo of course i don't mind your advice, any is welcome!.

Now the thorny issue of whether i can keep my creditors at bay while i save the £510!.... the next hurdle i fear!.

    Thanks all
  • You will get a 'nil' code for the remainder of that tax year. Usually the OR will want all of that . A nil coding can often be given to people who have overpaid tax. If you have big employer away from your place of work, who cares? If not some bright spark could check if they were sad enough
