Scammed by a seller

Hi,
I recently bought some goods over the phone after contacting a site called https://www.breakeryard.com
A man rang me straight back from a place called "German Spares" in Manchester. I bought the goods which cost £82.40 and they were arranged for next day delivery. I rang next day at midday as they hadn't arrived and was told they were on their way. I rang again at 4pm and was told "bear with us, delivery can be any time up to 6pm". Items have never arrived and it's now 6 days later and since then, I have rung them about 10 times, I get no answer, no call back and they have not refunded my card despite me asking them to do so each time.
I have contacted the credit card people twice (Amazon) and they have not got back to me either.
What should I do next?

  • If you paid by credit card (Amazon, from the sound of it) things are considerably simpler position than if you paid by debit card :) Just phone up your credit card company and ask to do a credit card chargeback under s75 of the Consumer Credit Act 1974. If they ask for what reason, explain the situation - it should come under 'no goods received.'

    If you're not getting any answer from the merchant, give Amazon a ring and ask for a chargeback - getting your money back from then on should be relatively simple :)

    As far as Im aware your credit card will only take responsibility if the amount is over £100 but I would be happy to be corrected if i am wrong.

    Legally Section 75 required the total purchase price to be over £100, but the Credit Card Provider are still able to "chargeback" lesser amounts.

    I have had refunds of amounts less than £100 where goods have not been received by simply asking for a chargeback.
